Thank you for choosing Beans Greens Proteins Mobile Apps. By participating in the program, you are agreeing to the terms and conditions presented here. You agree and understand that Mobile Applications may not be accessible or may be limited over some mobile networks, and while roaming.
You will continue to be subject to the terms and conditions of your existing agreements with any other service providers, including your mobile service carrier or provider (e.g., Verizon, Sprint etc.). and this Agreement does not amend or supersede any of those agreements. Those agreements may provide for fees, limitations and restrictions that might affect your use of Mobile Applications (for example, your carrier or provider may impose data or text message charges for your use of Mobile Apps), and you are solely responsible for all such fees, limitations and restrictions. If you have problems, you should contact us directly.
Availability. Your Mobile Apps will be published to the Mobile App Stores: Google Play Store & Apple Store. It is available on these major mobile service carriers in the U.S.: Androids & iPhones. Your customers will need to download the app, according to the type of phone they use. We assume no responsibility for the operation, security, functionality or availability of any Wireless Device or mobile network you or your customers use to access Mobile Apps. You agree to exercise caution when utilizing Mobile Apps on your Wireless Device and to use good judgment when obtaining or transmitting information. You agree that we and our service providers may send you, by short message service, email, and other methods, communications relating to Mobile Apps (with an opportunity to opt- out), including without limitation welcome messages, information and requests for information relating to use of Mobile Banking.
Our service may be unavailable, delayed, or interrupted, with or without notice, from time to time because of technical difficulties, maintenance, or events outside our control. We will have no liability to you or any other person for such interruptions, delays, or unavailability, although we may post alerts to our website for purposes of notifying you of such events. Proprietary Rights. You are permitted to use content delivered to you through Mobile apps. You may not copy, reproduce, distribute, or create derivative works from this content. Further, you agree not to reverse engineer or reverse compile any Mobile App technology, including, but not limited to, any software or other mobile device applications associated with it.
User Conduct. You agree not to use Mobile Apps or the content or information delivered through Mobile Apps in any way that would: (a) infringe any third-party copyright, patent, trademark, trade secret, or other proprietary rights; (b) be fraudulent or involve the sale of counterfeit or stolen items, including, but not limited to, use of Mobile App to impersonate another person or entity; (c) violate any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti- discrimination or false advertising); (d) be false, misleading or inaccurate; (e) create liability for us, or cause us to lose any services from our service providers; (f) be defamatory, trade libelous, unlawfully threatening or harassing; (g) reasonably be perceived as illegal, offensive or objectionable; (h) interfere with or disrupt computer networks connected (i) interfere with or disrupt the use of Mobile Banking by any other user; or (j) gain unauthorized entry or access to the computer systems or data of others.(k) Pornography and any sexually explicit communications (l) Obscenity in language, gestures and pictures.
What We Collect. We collect information on our users in various ways, such as voluntary submission, participation in company services, from third parties and through cookie and other tracking technology. We may collect the following: 1) Who you are, such as your name, email, phone no, portal address and possibly support and customer service issues 2) the Content, which includes code, information, text, graphics and other materials you submit through the company services 3) general, non-personal, statistical information about the use of company services, such as how many visitors visit specific page, which hyperlinks, if any, they click on, how long they stay on that page, and which hyperlinks, if any, they click on 5) cookies and other tracking technologies
How We Use Your Information. We may use your information in a variety of ways, including: 1) internal review 2) to improve company website and company 3) to optimize third party offers of products and / or services 4) to verify the legitimacy of content 5) to notify you about updates to the company website 6) to let you know about products, services and promotions that you may be interested in 7) for our marketing purposes 8) to fulfill and provide products and services including personalized or enhanced services requested by you 9) internal business analysis or other business purposes consistent with our mission.

We may make identifiable information, information you provided that is in association with your company account and the Content available to our employees and third parties with whom we contract for use to handle your account.
Indemnification. You agree to indemnify, defend, and hold us harmless from and against any and all claims, liability, damages, expenses and costs (including reasonable attorneys’ fees) caused by or arising from your use of Mobile Apps, your violation of this Agreement, your violation of applicable federal, state or local law, or your infringement (or infringement by any other user of your account) of any intellectual property or other right of anyone.
Mobile Apps is free to use any ideas, concepts, know-how or techniques that you send us for any purpose. However, we will not release your name or otherwise publicize the fact that you submitted materials or other information to us unless: (a) we obtain your permission to use your name; or (b) we first notify you that the materials or other information you submit to a particular part of this site will be published or otherwise used with your name on it; or (c) we are required to do so by law. You have the ability to notify your subscribers by text messaging to their mobile phones. Message & data rates may apply. To Stop the Program: To stop the messages coming to your phone, send a text that says STOP. They will receive a one-time opt-out confirmation text message. And after that, they will not receive any further messages.
Mobile App Location Based Information. If you use any location-based feature of Mobile App you agree that your geographic location and other personal information may be accessed and disclosed through Mobile App. If you wish to revoke access to such information you must cease using location-based features of Mobile App
PAYMENTS. You agree to pay for Mobile Apps in accordance with our fee schedule as amended from time to time. You authorize us to automatically charge your account for all such fees incurred in connection with Mobile Apps. If we add to or enhance the features of Mobile Apps, by using such added or enhanced features you agree to pay for them in accordance with the fee schedule. Your mobile device carrier’s standard messaging and data fees may apply. Termination of Service. We reserve the right to terminate, modify, or suspend your use at any time, with or without cause, including if we reasonably believe that you have breached our terms and conditions for use of. We further reserve the right to terminate, modify, or suspend your use in the event we establish new conditions and qualifications for use, and you, or your equipment and software, do not meet such conditions and qualifications. Technical Requirements. To use the Apps, you must have your own compatible mobile device (such as a cellular phone, smart phone or tablet) with internet access and a digital camera. All mobile devices and software must meet our minimum technical requirements and may change at our discretion at any time. Errors. You agree to notify us of any suspected errors as soon as possible. Unless you notify us within 30 days of a suspected error, advertisements shall be treated as correct, and you agree not to bring a claim against us for the suspected error. Disclaimer of Warranties. TO THE FULLEST EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED, IN CONNECTION WITH THE SERVICE AND SOFTWARE. IF YOU ARE A BUSINESS CUSTOMER, WE FURTHER DISCLAIM TO THE FULLEST EXTENT PERMITTED BY LAW, AND WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WITHOUT LIMITATION OF THE FOREGOING, WE MAKE NO WARRANTY THAT THE SERVICE OR SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOU AGREE THAT USE IT AND SOFTWARE IS AT YOUR OWN RISK AND ON AN “AS IS” AND “AS AVAILABLE” BASIS.
